What is Parental Responsibility?

This is the right to make choices of a legal nature for children in your care. Mothers automatically get it but it can be withdrawn through the courts. Fathers only get it if they are married to the mother at the time of birth (or conception in Scotland).

Births registered after December 1st 2003 (in England and Wales) are subject to a new regulation which seeks to give fathers equal say in their children's future and legal status. In Northern Ireland it came into force on 17th July 2001. Unmarried fathers will now get PR if they are named on the birth certificate.

Unmarried fathers can also obtain Parental Responsibility through a written agreement with the mother of the children or through a Court Order.
